The impact of the Civil Procedure Rules has, in our opinion, greatly improved the framework within which the solicitor and his expert operate. The overriding duty to the Court and the duty to properly advise and assist the client solicitor are in our opinion, interwoven as part of the service we offer.
For us, balancing these duties to the Court and the instructing solicitor requires experts capable of assessing for any particular claim, the likely merits and weaknesses of the claimant's case and the defendant's case. In essence, a solicitor wants an expert with the credentials and confidence to challenge the basis of the case.
We ensure that all our experts fully understand the nature of Civil Procedure Rules and the various professional ethical and procedural duties this places on the expert.
We ensure that all our experts submit themselves to membership of the Academy of Experts and seek a programme of continued training to enable them to offer a "rules sensitive" service.
We demand that our experts continually review the Court's published decisions that would have a bearing on the behaviour of our experts in the Civil Courts.
We train and re-train for the key moments when our expertise will be tested in report writing, through conference with counsel, for joint expert meetings and onto the Court.
Whether it is tree related structural failure of buildings, neighbour, drainage and boundary disputes, trip and slip claims, damage to property from falling trees or some other landscape related civil claim, we have the expertise to support your team.
